Subscription Privacy Policy

BY SUBSCRIBING TO THE SCENE PREMIUM, YOU AGREE TO THE FOLLOWING TERMS:

SUBSCRIPTION DETAILS & BILLING
1. SUBSCRIPTION PLANS
  1. You may select one of the following subscription plans (each a “Subscription”), which will renew automatically at the end of the applicable term subject to the AUTOMATIC RENEWAL terms at Section 2 below.
    1. The “Monthly Subscription”: Monthly Subscriptions are for a period of thirty (30) days at a fee of $1.99 per month (“Monthly Subscription Fee”).
    2. The “Annual Subscription”: Annual Subscriptions are for a period of twelve (12) months at a fee of $19.99 (“Annual Subscription Fee”).
  2. We reserve the right to modify the Subscription pricing for The Scene Premium at any time. In the event of a price modification, you will be notified at least thirty (30) days in advance of any such price modification. Price changes will only apply to new subscriptions or subscriptions that renew after the effective date of the price change.
  3. You may cancel your Subscription at any time. See Section 3 (CANCELLATIONS AND REFUNDS) below for details.
2. BILLING
  The Monthly Subscription Fee will be charged every thirty (30) days, and the Annual Subscription Fee will be charged every twelve (12) months, to the payment method associated with your account (the “Designated Payment Method”). The first charge will be on the date you subscribe to The Scene Premium (the “Subscription Date”). You may update your Designated Payment Method at any time by logging into your account at thescenenews.com. If you have any difficulty updating your payment information, please contact our customer support team at [email protected].
3. REJECTION OF PAYMENT
  If, at any time, we record a decline, or other rejection to your Designated Payment Method, we reserve the right to automatically terminate or suspend your subscription service.
AUTOMATIC RENEWALS
1. ANNUAL SUBSCRIPTION RENEWALS
  1. You acknowledge and agree that by subscribing to the Annual Subscription, you will be enrolled in and charged for an Annual Subscription on the Subscription Date and each annual anniversary thereafter on an automatic renewal basis. Each “Annual Subscription Period” will commence on the Subscription Date and continue for a period of twelve (12) months. You will be able to change your auto-renewal enrollment at any time during the Annual Subscription Period by toggling “Automatic Renewal” in your account settings to ‘off’. After toggling “off,” you can switch the Automatic Renewal toggle back to “on” at any time thereafter during the Annual Subscription Period to re-enroll in automatic renewal.
  2. If you wish to avoid automatic renewal charges to your Designated Payment Method, you also may cancel your Annual Subscription before the end of the Annual Subscription Period as further explained in Section 3 (CANCELLATIONS AND REFUNDS) below.
  3. Upon cancellation of your Annual Subscription your access to our Content will expire at the end of your Annual Subscription Period.
  4. If the “Automatic Renewal” toggle is switched to “on,” you will receive an e-mail at the e-mail address associated with your account thirty (30) days before the end of your Annual Subscription Period reminding you that your “Automatic Renewal” toggle is switched to ‘on’.
  5. If the “Automatic Renewal” toggle is switched on when your Annual Subscription Period ends: (a) you will be enrolled in a subsequent Annual Subscription plan, commencing the following business day; and (b) your Designated Payment Method will be charged the Annual Subscription Fee of $19.99 (including applicable taxes).
  6. You understand that unless you have terminated your Annual Subscription or switched the “Automatic Renewal” toggle to “off” before the end of your Annual Subscription, (i) your Annual Subscription will automatically renew on a recurrent basis at the beginning of each Annual Subscription Period; and (ii) we are authorized to charge your Designated Payment Method at the beginning of each subsequent Annual Subscription Period for any fees due, including the applicable taxes.
  7. Upon cancellation or expiration of your Annual Subscription, you can restart your access to our Content at any time by purchasing a new Subscription.
2. MONTHLY SUBSCRIPTION RENEWALS
  1. You acknowledge and agree that by subscribing to the Monthly Subscription, you will be enrolled in and charged for a Monthly Subscription on the Subscription Date and each thirty (30) days thereafter on an automatic renewal basis. Each “Monthly Subscription Period” will commence on the Subscription Date and continue for a period of thirty (30) days. You will be able to change your auto-renewal enrollment at any time during the Monthly Subscription Period by toggling “Automatic Renewal” in your account settings to ‘off’. After toggling “off,” you can switch the Automatic Renewal toggle back to “on” at any time thereafter during the Monthly Subscription Period to re-enroll in automatic renewal.
  2. If you wish to avoid automatic renewal charges to your Designated Payment Method, you also may cancel your Monthly Subscription before the end of the Monthly Subscription Period as further explained in Section 3 (CANCELLATIONS AND REFUNDS) below.
  3. Upon cancellation of your Monthly Subscription your access to our Content will expire at the end of your Monthly Subscription Period.
  4. If the “Automatic Renewal” toggle is switched on when your Monthly Subscription Period ends: (a) you will be enrolled in a subsequent Monthly Subscription plan, commencing the following business day; and (b) your Designated Payment Method will be charged the Monthly Subscription Fee of $1.99 (including applicable taxes).
  5. You understand that unless you have terminated your Monthly Subscription or switched the “Automatic Renewal” toggle to “off” before the end of your Monthly Subscription, (i) your Monthly Subscription will automatically renew on a recurrent basis at the beginning of each Monthly Subscription Period; and (ii) we are authorized to charge your Designated Payment Method at the beginning of each subsequent Monthly Subscription Period for any fees due, including the applicable taxes.
  6. Upon cancellation or expiration of your Monthly Subscription, you can restart your access to our Content at any time by purchasing a new Subscription.
CANCELLATIONS AND REFUNDS
1. REFUNDS FOR ANNUAL SUBSCRIBERS
  1. If you purchase an Annual Subscription, you may cancel anytime through the method described in 3(c) below. If you cancel within thirty (30) days of your Subscription Date, you will receive a full refund to your Designated Payment Method. If you cancel after thirty (30) days from your Subscription Date, you shall receive a pro-rated refund to your Designated Payment Method for the unused months in your Annual Subscription at a rate of $1.99 per unused month. Refunds will be processed within seven (7) to fourteen (14) business days from the date you give notice of your cancellation.
2. MONTHLY SUBSCRIBERS
  1. If you purchase a Monthly Subscription, you may cancel anytime. Upon cancellation, your Monthly Subscription will continue until the end of the Monthly Subscription Period, and you will not be entitled to a refund.
3. HOW TO CANCEL
  1. You may cancel your Subscription at any time by visiting your account at thescenenews.com and following the instructions for cancellation or contacting our customer support team at [email protected]. If you encounter difficulty with the cancellation process, please contact our customer support team at [email protected]. If you have the “Automatic Renewal” toggle switched off, your Subscription will automatically cancel at the end of your Monthly Subscription Period or Annual Subscription Period.
USER ACCOUNT
1. You are required to provide certain information about yourself in order to set up an account and access the features that are offered by us. We ask that you provide complete and accurate information. You may not impersonate someone else (e.g., adopt the identity of a celebrity or a friend), subscribe to The Scene Premium for anyone other than yourself or provide an email address other than your own.
TERMINATION
1. We reserve the right to terminate your Subscription at any time, in which case you will be notified in advance via email, and any unavailable and unutilized portion of your Subscription will be refunded.
THIRD PARTIES
1. We may include links or access to other web sites or services (“Linked Sites”) solely as a convenience to users. We do not endorse any such Linked Sites or the information, material, products, or services contained on other linked sites or accessible through other Linked Sites. Furthermore, we make no express or implied warranties with regard to the information, material, products, or services that are contained on or accessible through linked sites. ACCESS AND USE OF LINKED SITES, INCLUDING THE INFORMATION, MATERIAL, PRODUCTS, AND SERVICES ON LINKED SITES OR AVAILABLE THROUGH LINKED SITES, IS SOLELY AT YOUR OWN RISK.
LIMITATION OF LIABILITY
1. NO LIABILITY.
  Neither Broadway Licensing, its subsidiary and affiliate companies, nor any of the officers, directors, employees, partners, agents, affiliates or licensors of the foregoing shall be liable to you or any other person for any damages whatsoever, including any direct, indirect, incidental, special or consequential damages arising out of or relating to your use of our Site or Content. If applicable law does not permit exclusion of all damages, then your direct damages arising out of or relating to your use of our Site or Content shall be limited to one hundred U.S. dollars ($100).
2. ENFORCEABILITY.
  If any of the foregoing limits are not enforceable under applicable law, then they shall be construed to provide such limits to the fullest extent permitted by applicable law.
MISCELLANEOUS
1. INCORPORATION OF TERMS
  Please note that by subscribing to The Scene Premium, you acknowledge and agree to abide by our Terms of Service and Privacy Policy, which can be found on our website.
2. SEVERABILITY OF TERMS.
  If any provision of the Terms is found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties’ intention or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
3. MODIFICATION OF TERMS.
  These terms may be modified by The Scene Premium from time to time in our sole discretion. Upon modification, notice will be sent to the e-mail in your account.
4. GOVERNING LAW.
  You agree that these Terms or any claim, dispute or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including statutory, common law and equitable claims) between you and The Scene Premium arising from or relating to these Terms, their interpretation or breach, termination or validity, the relationships which result from these Terms, the Site, or any related transaction shall, to the maximum extent permitted by applicable law, be governed by the laws of the New York, without regard to its conflicts of laws rules.
5. NOTICES.
  Except as explicitly stated otherwise, legal notices will be served, with respect to The Scene Premium, and, with respect to you, to the current email address you provide to The Scene Premium. Notice will be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address provided during the Subscription process. In such case, notice will be deemed given three (3) days after the date of mailing. 6. CONTINUITY OF SITE.
  We reserve the right to modify, update, or discontinue the Site at our sole discretion, at any time, for any or no reason, and without notice or liability.
